Regulations on the postponement of local authority and PCC by-elections

 

The Local Government and Police and Crime Commissioner (Coronavirus) (Postponement of Elections and Referendums) (England and Wales) Regulations 2020 (SI 395/2020) were made on 3 April, laid before Parliament on 6 April and came into force on 7 April.

 

The Coronavirus Act 2020 postpones the elections due to be held on 7 May 2020 to 6 May 2021, including PCC elections. The Act extends the term of office of the current incumbent for a year and reduces the term of office of the person elected in the postponed elections from four to three years (to allow a return to the usual electoral cycle).

 

These Regulations cover by-elections in England for principal councils, parish councils, constituency members of the Greater London Authority (GLA), the Mayor of London, elected mayors and combined authority mayors. They include polls under s116 of the Local Government Act 2003 and referendums on governance and neighbourhood planning. The Regulations also cover Police and Crime Commissioners (PCCs) in England and Wales and postpone any PCC by-elections until 6 May 2021.

Regulations on police and crime panel meetings




The Local Authorities and Police and Crime Panels (Coronavirus) (Flexibility of Local Authority and Police and Crime Panel Meetings) (England and Wales) Regulations 2020 (SI 392/2020) were made on 1 April, laid before Parliament on 2 April and came into force on 4 April. They have been introduced as a result of current social distancing requirements and allow local authority and police and crime panel meetings on or before 7 April 2021 to be held virtually. It will be possible to make amending secondary legislation to bring forward this date if social distancing rules are relaxed or removed on the basis of medical and scientific advice.

 

Part 4 of the Regulations allows Police and Crime Panels in England and Wales to hold meetings remotely including by video conferencing, live webcast, and live interactive streaming. It also allows public and press access to Police and Crime Panel meetings to be complied with through remote means and website access.
